Welcome to SageWiz. By accessing or using our platform, website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and SageWiz ("we," "us," or "our"). We reserve the right to update these Terms at any time, and continued use of the Service constitutes acceptance of the updated Terms.

2. Description of Service

SageWiz is an educational platform that provides information about natural health approaches, functional medicine principles, and holistic wellness. Our Service analyzes user-provided information to generate personalized educational content about herbs, supplements, foods, lifestyle modifications, and natural remedies.

3. User Accounts & Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

4. Subscription & Billing

4.1 Subscription Tiers

SageWiz offers multiple subscription tiers (Explorer, Seeker, Healer, Guardian) with varying features and pricing. Specific details about each tier are available on our pricing page and are incorporated into these Terms by reference.

4.2 Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed through our third-party payment processor (Stripe)
• You authorize us to charge your payment method for all applicable fees
• All fees are in U.S. Dollars unless otherwise stated
• Taxes may be added to fees where applicable

4.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will send you reminder emails 7 days and 3 days before automatic renewal.

4.4 Cancellation & Refunds

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of your current billing period
• You retain access to paid features until the end of your paid period
• Refunds are issued on a pro-rata basis for mid-period cancellations (at our discretion)
• One-time credit pack purchases are non-refundable

4.5 Price Changes

We reserve the right to modify subscription pricing. Price changes for existing subscribers will take effect at the next renewal period, with at least 30 days advance notice.

5. Medical Disclaimer & Limitations

5.1 No Doctor-Patient Relationship

Using the Service does not create a doctor-patient relationship between you and SageWiz or any of its employees, contractors, or affiliates. We are not healthcare providers and do not practice medicine.

5.2 Safety Gatekeeper

Our Service includes a "gatekeeper" system designed to identify serious symptoms that require immediate medical attention. If the gatekeeper detects concerning symptoms, you will be directed to seek professional medical care. This system is not infallible and does not replace your own judgment or the advice of healthcare professionals.

5.3 Contraindications & Interactions

While we provide information about potential herb-drug interactions and contraindications, this information may not be complete. Always consult with a healthcare professional before starting any new supplement, herb, or natural remedy, especially if you are taking medications, pregnant, breastfeeding, or have pre-existing medical conditions.

6. User Responsibilities

When using the Service, you agree to:

• Provide accurate and truthful information about your health and symptoms
• Use the Service in compliance with all applicable laws and regulations
• Not use the Service to diagnose or treat serious medical conditions
• Not rely solely on the Service for health decisions
• Not submit protected health information (PHI) on behalf of a healthcare provider or for clinical care
• Not share your account credentials with others
• Not attempt to reverse engineer, decompile, or extract source code from the Service
• Not use automated tools (bots, scrapers) to access the Service
• Not violate any intellectual property rights
• Not transmit viruses, malware, or malicious code

7. Intellectual Property

10. Indemnification

You agree to indemnify, defend, and hold harmless SageWiz, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Any health decisions or actions you take based on information from the Service

11. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information.

12.3 Class Action Waiver

You agree that any arbitration or court proceeding shall be limited to the dispute between you and SageWiz individually. You waive any right to participate in a class action, collective action, or representative action.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or by posting a notice on the Service at least 30 days before the effective date of the changes.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription.

14. Severability & Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
